Legal Issues
- 1 Whether there has been a substantial or unforeseen change since the 2007 consent maintenance order
- 2 Whether husband’s retirement, income reduction and use of pension justify reducing maintenance
- 3 Whether wife has means or earning capacity to be self-supporting (including value of her home)
Ratio Decidendi
Although the 2007 consent order stands until a reasonable transition period expires, the husband’s retirement and changed finances constitute a material change warranting eventual reduction. The court found the husband retained assets (education fund and a car) and earning capacity (assessed ability to earn HKD14,000 plus pension HKD22,135 = HKD36,135) and that sale of assets (car ~HKD200,000) could bridge the shortfall only until mid‑2018. Balancing wife’s mortgage needs and income (disability allowance and limited earning capacity), the court held maintenance of HKD10,000 should continue until 30 June 2018 and then be reduced to a nominal HKD1 per year thereafter until death or remarriage.
Court Disposition
Application granted in part: existing periodic payment of HKD10,000 per month maintained for limited period, then reduced to nominal maintenance
Orders
- From 1 July 2018 the husband shall pay the wife a symbolic maintenance payment of HKD1 per year payable for life or until the wife remarries, whichever occurs first
- The 2007 order (HKD10,000 per month) remains in full force and effect until 30 June 2018
