Procedural Posture

Civil Appeal Against Registrar's Order / Hearing of Appeal in High Court; Judgment Handed Down

  1. 1 Whether a default judgment signed after service by registered post to the defendant's usual or last known address (and before any returned envelope) can be set aside later without the defendant showing a meritorious defence if satisfactory proof of non‑service is adduced
  2. 2 Whether service by registered post to a last known address is deemed effective under local rules and statutes
  3. 3 Whether an irregular judgment (if established) must be set aside ex debito justitiae or whether the court retains a discretion requiring proof of merits

Ratio Decidendi

Where a writ is sent by registered post to the defendant's usual or last known address and the postal packets are not returned, service is deemed effective under Order 10 r.1(2)(a) and Cap.1 s.8; a default judgment signed on that basis is regular and the defendant cannot obtain its setting aside as of right without showing a meritorious defence; accordingly the Registrar's order setting aside the judgment was wrong and is set aside on appeal.

Court Disposition

Appeal allowed in part; Registrar's order set aside and default judgment restored
