DCMP 4484/2021 [2024] HKDC 505 香港特別行政區 區域法院 雜項案件2021年第4484號 ------------------------------- IN THE MATTER of Order 113 of the Rules of District Court, Cap. 336H, Laws of Hong Kong 及 IN THE MATTER of the property known as ALL THAT piece or parcel of ground situate lying and being at Tai Po, New Territories, Hong Kong and registered in the Land Registry as LOT NO.1249 in DEMARCATION DISTRICT NO.11 together with the messuages, erections and buildings thereon or some part thereon (if any) (“THE PREMISES”) ------------------------------- CHU SYMON HIN WING CHU YUM KO DANIEL（朱蔭高）and CHU HUM HONG （朱蔭康） as managers of CHU NAM YUN (OR YUEN)（朱南園）suing on behalf of all members of 原告人 CHU NAM YUN (OR YUEN)（朱南園） 訴 第二被告人 潘家駿 -------------------- 主審法官： 區域法院暫委法官鄺嘉彤 聆訊日期： 2024年3月27日 判決日期： 2024年3月27日 判決書日期： 2024年4月5日 ------------------- 判決書 ------------------- 引言 於2022年5月3日，區域法院司法常務官就本案的涉案土地頒下收回管有命令。 於2023年12月27日，區域法院聆案官應第二被告人提出的申請把上述收回管有命令作廢，並命令此訴訟將猶如以令狀展開的形式繼續進行。 原告人不服聆案官的裁決，於2024年1月4日提出上訴。 根據確立已久的原則，就聆案官於內庭所作的裁決而提出的上訴，一般而言法庭會以重審的方式處理（參看Hong Kong Civil Procedure (2024)，第58/1/2段）。 本席於2024年3月27日的聆訊聽取了雙方的陳詞，並裁定原告人上訴得直，理由如下。 背景 朱南園是一個根據新界條例（香港法例第97章）第15條所註冊的祖堂，於大埔南坑村持有多塊土地，包括涉案土地。 原告人以朱南園司理人的身份代表朱南園的成員於2021年11月30日以原訴傳票的方式展開此訴訟，根據區域法院規則第113號命令要求收回涉案土地的管有權。 從原告人代表律師就派達法庭文件所呈交的誓章及照片可見，原告方於2021年12月16日及2022年3月10日把本案的原訢傳票，用作支持申索的誓章，與及有關聆訊延期的通知書張貼於涉案土地的多個顯眼地方（例如大門、水錶、及信箱等)。從照片可見，上述文件以透明的文件夾裝載。 第二被告人聲稱他是涉案土地的合法租客，並早於2013年跟姓莫的業主（“該莫姓男子”)簽訂租約。 第二被告人並不否認他一早得知有關此訴訟的糾紛。就這點，第二被告承認有關業權糾紛的法律文件確實被送達到他的居所（看第二被告人於2022年12月23日所提交的傳票，於同日所作的誓章，與及於2023年3月22日所作的誓章）。可是，該莫姓男子要求他把文件交出，原因是租客無權過問有關業權糾紛的事宜。怎料，該莫姓男子沒有出庭抗訴，導致原告人在沒有反對的情況下獲得收回管有命令。 第二被告人於2022年12月23日發出傳票，申請暫緩執行收回管有命令，讓他有足夠時間申請法援及傳召該莫姓男子及原告人出庭答辯。 於2023年5月11日，聆案官作出命令准許第二被告人加入本案成為訴訟方，並命令暫緩執行收回管有命令直至2023年6月12日。 於2023年7月18日，第二被告人發出傳票，申請撤銷法庭於2022年5月3日所頒下的收回管有命令，並要求法庭重新進行聆訊。 如上文提及，聆案官於2023年12月27日把收回管有命令作廢，並命令此訴訟將猶如以令狀開展的形式繼續進行。原告人不服聆案官的判決，於2024年1月4日提出上訴。 法律原則 於Karupayee Ammal v Moorthy Selvaraj [2020] HKCFI 289 第26段至30段，高等法院原訴庭法官楊家雄指出： “26. The jurisdiction conferred by Order 113 should be exercised only in clear cases. But if the case is a clear one, it cannot matter that the defendant has contested it. The test is whether the issue between the parties, be it one of fact or law, is one which the defendant is entitled to have sent to a trial — see Vipac Engineers & Scientists Ltd v Mark Karpovich and Another [1990] 1 HKLR 725, per Godfrey J at 726I to 727C. When considering an application under Order 113, the applicable approach is not to be significantly different from the approach under Order 14 — see Direk Mahadumrongkul v Lau Chun Keung & Others, CACV 133/1998 (unrep, 16 Oct 1998, per Nazareth VP at pp 7, having cited Vipac with approval). In Re Safe Rich Industries Limited, CACV 81/1994 (unrep, 3 November 2994), Bokhary JA observed at §13 that the test at the summary stage is as simple as whether the defendant’s assertions are believable. No mini-trial on affidavit evidence should be attempted. Mr Chan refers me to Mutual Luck Investment Ltd v Chiu Yim Man [1999] 3 HKC 399, wherein Keith J referred to an earlier decision of his Lordship and observed that: “ …As was said in Kung Wong Sau Hin v. Sze To Chun Keung (HCMP 1614/90), the Ord. 113 procedure will not ‘ usually be an appropriate vehicle for the recovery of land which has been occupied by many families for very many years. Such cases will invariably raise issues of both fact and law which cannot properly be investigated without proper pleadings and following a trial at which the rules of evidence are adhered to.’ ” I do not read the learned Judge as meaning to lay down any invariable rule that any particular type of claims is not appropriate for the Order 113 procedure. The facts of each application will have to be looked at and considered separately. But the learned Judge is obviously correct in observing that where cases raise issues of both fact and law which cannot properly be investigated without proper pleadings and following a trial, the Order 113 procedure will be inappropriate. As in an Order 14 application, the onus to show that there is a triable issue is on the Defendant.” 上訴庭接納並曾採用上述法律原則（參看Incorporated Owners of No 202 Portland Street v Wong Yu Shek & Anor [2022] HKCA 393, 第17至18段, 上訴庭法官周家明）。 《區域法院規則》第113號命令第8條規定： “法官可施加他認為公正的條款而將任何在根據本命令進行的法律程序中作出的命令作廢或更改。” 有眾多案例指出基於第113號命令第8條作廢收回管有命令的法律原則與基於第13號命令第9條或第19號命令第9條撤銷缺席判決的法律原則類似。法庭首先要考慮的是收回管有命令是屬於常規（regular）或非常規（irregular）。若然收回管有命令屬於常規，被告人須證明其抗辯理由具備真實的勝算把握（there is a reasonable prospect of success），及有一定程度的堅信性或可信性（carries some degree of conviction）。 於Gotland Enterprises Limited v Kwok Chiu Yai & Ors （HCMP 4550/2003, 2017年5月12日），第10段至第13段，高等法院原訴庭法官陳健強指出： “10. O 113, r 8 provides that: “The judge may, on such terms as he thinks just, set aside or vary any order made in proceedings under this Order.” 11. It is not in dispute that in deciding whether to set aside the Writ, the considerations for the court are similar to those for an application to set aside a default judgment pursuant to O 13, r 9 (see Hong Kong Civil Procedure 2017, vol 1 (HKCP), rubric 113/8/12). 12. It is common ground that the issues in this application are: (1) whether it is appropriate to join Chan as a party; (2) whether the service of the OS was irregular; and (3) whether Chan’s claim of adverse possession has a real prospect of success. 13. Normally, the court will consider issue (2) first because if the service was irregular, the Writ (see further discussion below), insofar as it affects the Land, should be set aside as of right (see HKCP 13/9/4). However, even if the service was regular, the court retains a discretionary power to set aside the Writ in order to avoid any injustice: see HKCP 13/9/12. For that matter, the court will have to consider the merits of Chan’s case (issue (3)). As for issue (1), Mr Hu, appearing for Gotland, accepted that the joinder of Chan as a party to these proceedings hinges on the merits of his case.” 於Tse Mei Ling administratrix of the Estate of Tse Yau Tung v 謝達德 [2021] HKDC 1537，第22段及26段，區域法院法官梁國安指出： “22. Order 113, rule 8 provides that “the judge may, on such terms as he thinks just, set aside or vary any order made in proceedings under this Order.” …….. 26. In the setting aside application under Order 113, the Court consistently applies the standard in the setting aside of a default judgment as to merits, ie whether the defence carries a real prospect of success (or whether the defence “could well be established”) at trial, ie not merely arguable but carries some degree of conviction: Kwong Shook Ling (as sole executrix of the estate of Yu King Kwok, deceased) v The Occupants of Lot No. 841 in Survey District No. 3, Sai Kung, New Territories & Anr, HCMP 2859/2003 and Gotland Enterprises Limited v Kwok Chi Yau & Others HCMP 4550/2003.” 本席緊記並引用上述法律原則。 分析 首先要處理的議題是法庭於2023年5月3日所頒下的收回管有命令是否一個常規的法庭命令。 如上文提及，原告人的律師已把法庭文件派達到涉案土地（即是第二被告人的居所）並把文件張貼於顯眼的地方，而第二被告人亦坦言承認曾經收到有關本案糾紛的法律文件，並得知文件與業權糾紛有關。可是，第二告人卻聲稱選擇把相關法律文件交給莫姓男子，沒有親自跟進案件。 基於上述情況，被告人在法庭頒下回收管有命令之前已得知原告人展開此訴訟，而原告方亦已根據第113號命令第4條規則把此訴訟的相關法庭文件派達給土地的佔用人（即是第二被告人）。 本席認為毫無疑問2023年5月3日的收回管有命令是一個常規的法庭命令。 接下來要處理的議題是第二被告人能否提出有勝算把握或可信的抗辯理由。 第二被告人於本案呈交了一共六份誓章。簡言蓋之，第二被告人的說法可概括如下： 從2013年開始他從莫姓男子租用涉案土地作為他的居所。該莫姓男子自稱是業主，並每月收取租金。 莫姓男子近來向第二被告人透露他於十數年前獲得原告人及其家族成員同意，可以代表業主管理物業，並且向租戶收租。 該莫姓男子是業主的代理人，他誤導第二被告人，導致法庭在沒有反對的情況下頒下收回管有命令。 本席認為本案的重點在於第二被告人能否提出可信及實質的證據來證明他有權繼續佔用涉案土地。 根據第二被告人的說法，他是以租客的身份向莫姓男子租用涉案土地。由於第二被告人多年來願意就使用涉案土地提交租金，他顯然沒有霸佔土地的意圖，因此他不能倚賴逆權侵佔的法律原則作抗辯理由（參看 Wong Tak Yue v David Kung (1997-1998) 1 HKCFAR 55，第69頁(D-F)（李國能首席法官）。事實上，第二被告人並沒有提出他逆權侵佔涉案土地。 第二被告人亦沒有提出莫姓男子逆權侵佔涉案土地。就這點，根據第二被告的說法，莫姓男子自稱是業主的代理人，並獲得原告人或其家族成員同意代表業主收租。這說法顯然跟逆權侵佔背道而馳。根據第二被告人的說法，莫姓男子只是在獲得業主的許可下行事，他沒有可能是一個業權侵佔者，有權可以在註冊業主不同意的情況下把涉案土地租出。 第二被告人沒有呈交任何文件證明他與莫姓男子就涉案土地達成了租務協議。第二被告人沒有提供任何租約或租單，亦沒有提供任何紀錄證明他每月把租金交給莫姓男子。第二被告人甚至未能夠在誓章中交代租約的詳情（例如租約於什麼情況下定立、每月租金多少，與及租約的具體條款等）。第二被告人於庭上說一位姓劉的女士曾經跟該莫姓男子簽訂租約，租金為每月$8,000，而雙方更為租約安排打釐印。可是，第二被告人並未有於本案所呈交的六份誓章中談及這事情，更沒有提供這份租約。正如管大律師於庭上指出，土地註冊紀錄更沒有顯示第二被告人所聲稱的租約是存在的。 而更重要的是第二被告人未能提供任何證據證明該莫姓男子真的曾經獲得朱南園的司理人授權管理及出租涉案土地。就這點，第二被告人亦未能指出朱南園的司理人作出了什麼行為導致他相信該莫姓男子有權限可以把涉案土地出租。 由始至終，第二被告人只是倚賴該莫姓男子的口頭傳聞證供，他的說法沒有實質證據支持，只是空口講白話，而內容亦極度空泛。第二被告人無法證明他真的與該莫姓男子進行相關對話。儘管第二被告人真的與該莫姓男子進行相關對話，第二被告人也無法證實該莫姓男子的說法是否屬實。 第二被告人於庭上陳詞時說原告人沒有可能多年來對涉案土地不聞不問，因此該莫性男子必定獲得授權管理及出租土地。可是，眾所周知，新界有大量土地被非法霸佔，衍生什多有關逆權侵佔的訴訟。本席不能由於原告人沒有參與涉案土地的事宜，便就此推論該莫性男子必定已獲得原告人授權出租物業。就這點，管大律師指出如記錄所顯示，由2003年至2018年沒有任何成員出任朱南園的司理人，出現職位懸空的情況，因此根本沒有任何人士可在相關時間獲得授權管理或出租涉案土地。綜合本案的證據與及客觀情況，本席無法認同第二被告人所提出的推論。本席認為第二被告人的說法是在沒有事實基礎情況下所作出的猜測。 基於上述原因，本席認為第二被告人的案情極為薄弱，毫無勝訴機會，也沒有任何說服力。第二被告人無法提出任何實質證據證明該莫姓男子有實質權限（actual authority）或表面權限代（apparent authority）代表朱南園的司理人出租涉案土地。 原告人的案情指朱南園的司理人並不認識莫姓男子，亦從來沒有以直接或間接的方式委託他把涉案土地放租。原告人亦說由於收到來自地政處有關違規建築的來信，他們於2019年5月到大埔南坑村進行視察時才發現大量朱南園的土地（包括涉案土地）被非法佔用。 不論如何，儘管該莫姓男子真的曾經獲得司理人授權管理或出租朱南園的物業，這並不代表司理人無法或不可解除該莫姓男子的權限。原告人的立場顯然易見，早於2021年11月原告人展開此訴訟，表明不容許任何人繼續霸佔或使用涉案土地。第二被告人無法解釋他為何可以在註冊業主不同意的情況下一直繼續使用涉案土地。第二被告人的主張不合理，亦沒有法律基礎。 結論 基於上述原因，本席裁定原告人上訴得直，並撤銷聆案官於2023年12月27日所作的命令。 本席亦撤銷原告人於2023年7月18日所發出的傳票。 第二被告人是敗方，在一般情況下他要支付原告人的訟費。可是，鑒於第二被告人是一位長者並且財政狀況未必理想，管大律師於庭上表示原告人自願作出讓步，釋出善意，不作訟費申請。因此，本席就此上訴及原告人於2023年7月18日所發出的傳票不作訟費命令。 最後，本席感謝管大律師的專業表現與及為法庭所提供的協助。 （ 鄺嘉彤 ） 區域法院暫委法官 原告人： 由Dickman L T Chan & Co律師事務所Mr Koon Jay大律師代表 第二被告人：沒有律師代表，並親自應訊
