Extension of time and leave to appeal were refused because the applicant (X) produced no acceptable excuse for a substantial nine‑week delay, pursued an abusive and manifestly misconceived Order 73 rule 10(6) application to delay enforcement, failed to show a real prospect of success on appeal given the court's acceptance of the applicant's expert evidence that the Award remained valid and binding except on a narrowly confined evidence issue, and because the Hong Kong court should not duplicate proceedings better suited for determination by the Mainland court; accordingly leave and stay pending appeal were declined and indemnity costs awarded to G.
