The plaintiffs did better than their sanctioned offers and it was not unjust to make orders under Order 22 r 24; the court exercised its discretion to award enhanced interest at 6% above the US dollar prime from 5 June 2012 until judgment (thereafter at judgment rate) and indemnity costs from 5 June 2012 with interest at half the lower of (i) 6% above US dollar prime or (ii) 2% above judgment rate from 5 June 2012 until judgment (thereafter at judgment rate); the court found it lacked jurisdiction to award enhanced interest or interest on costs beyond judgment under O.22 r.24.
