On the balance of probabilities the parties had a common intention that the Deceased was the sole beneficial owner; the Deceased and Widow provided the purchase funds and maintained the property, the defendant never occupied the Property and his contemporaneous conduct (including the 2009 transfer application) indicated he held legal title only; it is unconscionable for the defendant to assert sole beneficial ownership and therefore he holds his legal title on trust for the Deceased and now his estate; accordingly the court declared the estate solely beneficial owner and ordered transfer to the administratrix.
