Procedural Posture

Criminal Appeal (application for Leave to Appeal Against Conviction) / Application for Leave to Appeal

  1. 1 Whether the evidence was sufficient to support a conviction for possession for the purpose of trafficking
  2. 2 Whether the trial judge impermissibly relied on subjective impressions when rejecting the defendant's account
  3. 3 Proper inferences to be drawn from possession, quantity, packaging, conduct and surrounding circumstances

Ratio Decidendi

The judge lawfully rejected the defendant's account as implausible and, taking that rejection together with objective factors — the quantity and packaging of drugs, estimated market value, the defendant's conduct (not returning home), lack of credible explanation of purchase price and drug habit, and possession of multiple phones — reached the only reasonable conclusion that the drugs were possessed for supply; accordingly the leave application failed.
