On the facts the court found the payments above the agreed annual rent were gifts/pocket money to the Plaintiff's children not advance rental, the Defendant failed to establish proprietary estoppel, the tenancy remained annual and terminable by the Plaintiff, and accordingly Plaintiff was entitled to recover vacant possession; mesne profits were awarded at $1,000 per annum from 1 May 2002 until delivery of possession together with interest and costs as ordered.
