Procedural Posture

Application for Leave to Appeal and Stay of Execution / Post Judgment Application in District Court (application for Leave to Appeal; Stay Application)

  1. 1 Whether leave to appeal should be granted
  2. 2 Whether a stay of execution should be granted
  3. 3 Whether the plaintiff proved its alternative case under paragraph 20B

Ratio Decidendi

Leave to appeal was refused because the plaintiff had no reasonable prospect of success: the trial judge found the plaintiff was obliged to provide receipts/vouchers before charging expenses or claiming reimbursement, that the defendant was not obliged to settle the six Purchase Orders within 30 days, and that the plaintiff breached the Agreement by demanding full payment without apportionment; the Open Book accounting remedy was properly ordered but requires supporting documentation; the plaintiff's acceptance of repudiation was wrongful; and the counterclaim established a legal right allowing at least nominal damages.

Court Disposition

The plaintiff's summons dated 31 July 2015 is dismissed; leave to appeal refused; stay of execution denied; costs awarded to the defendant.
