The court concluded that disclosure in aid of Dingway’s proprietary claim was necessary to trace the US$70,000,000 and to give effect to the proprietary injunction; the defendant’s complaint of delay did not make it unreasonable or practically unjust to grant disclosure because any prejudice was limited to additional costs and time which can be addressed by costs orders; accordingly the disclosure order (paragraphs 1 and 3 of the summons as amended) was granted with 28 days to comply and costs on a nisi basis to the plaintiff.
