Procedural Posture

Libel (defamation) / Interlocutory Application for Further and Better Particulars and Discovery (ruling)

  1. 1 Whether the defendants' pleading amounted to a conventional plea of justification
  2. 2 Whether the defendants furnished sufficient particulars to support justification of the plaintiff's alleged 'false innuendoes'
  3. 3 Scope and limits of discovery where justification is pleaded in libel actions

Ratio Decidendi

Defendants failed to particularise incidents sufficient to ground a general discovery order; discovery in libel cases where justification is pleaded is limited to documents relating to incidents the defendant has already particularised. Therefore the general application for a further and better list and broad discovery was dismissed, but limited disclosure was ordered only in respect of companies and documents which the defendants had adequately particularised (Robina Department Store and Robin Construction) and a narrow affidavit requirement imposed.

Court Disposition

Application partly dismissed and partly granted (limited discovery and affidavit ordered; broad discovery refused).

Orders

  • Part of defendants' application for a verified further and better list of documents and broad discovery dismissed.
  • Plaintiff ordered within 14 days to file an affidavit stating whether he has audited profit and loss accounts and balance sheets for Robina Department Store (Private) Ltd. for years 1972, 1974 and 1975.
