The court preferred the Ips' evidence, found the Cooperation Agreement and surrounding conduct established that Mr Hui had ostensible authority to negotiate and effect the Settlement Agreement, found Wellpoint's principal witness unreliable and that key invoices were created after the event, and held that the Settlement Agreement discharged the disputes and that Wellpoint failed to prove any outstanding quantum; accordingly Wellpoint's claim and the Ips' counterclaim were dismissed.
