A magistrate may not adopt a starting point that exceeds the statutory maximum penalty for the offence and the magistrate's jurisdiction; where a magistrate has used an excessive starting point the appellate court will substitute a proper starting point not exceeding the statutory maximum, reapply the appropriate discount for guilty plea and substitute the sentence accordingly.
