The court refused the defendants' case-management stay because the judicial review issues did not decisively subsume the private-law issues in the regional proceedings, most defendants had or might have independent private-law defences that must be pleaded now (res judicata concern), the balance of convenience and fairness favored continuing proceedings, and a blanket adjournment pending JR is inappropriate; the court also declined to order a fast-track trial because of prejudice to defendants and the pending JR timetable, but directed that parties should revisit timetabling after the JR hearing.
