The court refused the case‑management stay because the balance of convenience, fairness and efficient use of court resources favored continuation: pending JR would not necessarily render the private proceedings pointless, many defendants had private law defences that must be pleaded and determined to avoid res judicata problems, defendants could seek appropriate interlocutory relief in the High Court (eg interim prohibitory relief) if necessary, and the factual and legal differences between the JR and the Regional Court proceedings meant an automatic stay was inappropriate.
