Procedural Posture

Criminal Sentencing Appeal (out of Time Application) / Application for Permission to Appeal Against Sentence (out of Time); Appeal Allowed in Part

  1. 1 Whether permission to appeal out of time should be granted
  2. 2 Whether additional sentence reduction is warranted for post-sentence cooperation that led to subsequent convictions
  3. 3 What range of credit is appropriate for assistance to authorities and what principles govern such credit

Ratio Decidendi

The court granted permission for an out-of-time appeal and allowed the appeal in part: although the original 45.8% reduction was already generous, the applicant's post-sentence assistance to Customs produced tangible prosecutorial 'fruit' (resulting in arrests and convictions), and on that basis the applicant was entitled to further credit so that the total reduction reached 50%; accordingly the trafficking sentence was reduced from 13 years to 12 years while the concurrent 20-month sentence for handling proceeds was maintained.

Court Disposition

Appeal allowed in part; permission to appeal out of time granted; sentence varied.

Orders

  • Permission to appeal out of time granted
  • Trafficking sentence reduced from 13 years to 12 years
