Ng Yee Tim
1st Defendant
The Incorporated Owners of Wing Lee Mansion No.25 Austin Avenue
2nd Defendant
Procedural Posture
Civil Building Management / Property Dispute / Trial and Judgment (high Court)
Legal Issues
- 1 Whether Plaintiff had standing to pursue Account and Appointment claims on behalf of the Incorporated Owners (derivative action/locus standi)
- 2 Whether the appointment of chairmen/management committee members was valid
- 3 Whether the treasurer (1st Defendant) improperly withheld or misappropriated accounts and whether an account remedy was appropriate
Ratio Decidendi
The court held that the Account and Appointment claims could not validly be pursued by the Plaintiff on a derivative basis because the management committee was the proper organ to enforce corporate rights, the committee had been regularised and the Incorporated Owners had, by later resolutions and conduct, declined to pursue the account claims; independently, the 1st Defendant's long open occupation of the yard since about 1974, without successful complaint by co-owners and in circumstances of acquiescence, defeated the trespass claim by adverse possession/limitation. Accordingly all live claims against the 1st Defendant were dismissed and costs were ordered nisi in his favour.
Court Disposition
All live claims by the Plaintiff against the 1st Defendant dismissed; costs ordered nisi in favour of the 1st Defendant; no order made in relation to academic dispute between Plaintiff and the Incorporated Owners; proposed late amendments to join the Incorporated Owners as co-Plaintiff disallowed.
Orders
- Plaintiff's Account and Trespass claims against 1st Defendant dismissed
- Order nisi for costs in favour of 1st Defendant (Ng Yee Tim)
