Procedural Posture

Contract for Sale of Property / Misrepresentation / Judgment at Trial (court of First Instance)

  1. 1 Whether agent (Mak) made actionable representations to plaintiff
  2. 2 Whether statements amounted to factual misrepresentations or mere sales 'puff'
  3. 3 Whether plaintiffs were induced by any representation to enter contract

Ratio Decidendi

Judge found on balance that the words uttered by the on-site salesman were no more than routine sales puff and did not constitute actionable representations, and that plaintiffs were not induced by any such representations; further, on the evidence the sewage backflow was caused by intermittent foreign-body blockages rather than a design defect. Accordingly plaintiffs failed to prove misrepresentation or causation of a latent defect and their claim for rescission or damages was dismissed.
