C. MASILAMANI MUDALIAR AND ORS. versus THE IDOL OF SRI SWAMINATHASWAMI SWAMINATHASWAMI THIRUKOIL AND ORS.

Where a Hindu female acquires or possesses property by virtue of recognition of her pre-existing right to maintenance, even if the instrument restricts her estate, Section 14(1) of the Hindu Succession Act, 1956 applies, and her limited estate blossoms into absolute ownership. Section 14(2) operates only when property is acquired for the first time without any vestige of pre-existing right. In this case, Sellathachi possessed property in lieu of maintenance, hence her estate became absolute by virtue of Section 14(1).
