N. MOHAN versus R. MADHU

N. MOHAN versus R. MADHU

The Court held that a defendant cannot be deprived of the statutory right to file a first appeal under Section 96(2) CPC merely because an earlier application under Order IX Rule 13 CPC was dismissed; whether time spent pursuing Order IX Rule 13 proceedings amounts to "sufficient cause" for condonation of delay in filing the appeal depends on facts including bona fides and absence of dilatory tactics. Applying these principles, the Court condoned the delay of 546 days in filing the first appeal subject to the appellant depositing Rs.20,00,000 by the specified date and other conditions.
