DR. BALBIR SINGH AND ORS. ETC. ETC. versus MUNICIPAL CORPORATION, DELHI AND ORS.

DR. BALBIR SINGH AND ORS. ETC. ETC. versus MUNICIPAL CORPORATION, DELHI AND ORS.

The rateable value of a property for municipal assessment cannot exceed the figure of standard rent determinable under the Rent Control Act, but may be lower. Standard rent must be estimated on statutory principles, not merely by the existence or absence of actual evidence, and the assessing authority is competent to estimate cost and market price when necessary. Resort to Section 9(4) (Delhi Rent Control Act) is permitted only if the standard rent cannot be determined by the principles in Section 6.
