Respondent

Procedural Posture

Civil Appeal / Appeal by Special Leave From Judgment and Order Dated 8th April, 1970 of the Punjab & Haryana High Court in L.p.a. No. 433/1969

  1. 1 Whether the appellant was given proper rank in the joint seniority list after integration of two services
  2. 2 Interpretation of 'continuous service' and 'date of appointment' under State administrative memorandum
  3. 3 Whether State Government could reckon seniority from the date of appointment irrespective of date of assumption of charge

Ratio Decidendi

The length of continuous service for determining inter se seniority in the integrated cadre was to be reckoned from the date of appointment as specified in the State Government's memorandum; since respondents' appointments were effective from 8th April, 1964 (with immediate effect), their seniority is to be reckoned from that date regardless of when they assumed charge. Thus respondents were senior to the appellant.

Court Disposition

Appeal dismissed

Orders

  • Joint seniority list of integrated PCMS Class I upheld giving seniority to respondents 3 to 19 over Dr. Jagjit Singh and the appellant
