On the evidence of five natural eyewitnesses and medical testimony showing homicidal gunshot injuries, the Court held that Amerika Rai (A-1), Mithilesh Rai (A-4), Sanjay Rai (A-5) and Sipahi Rai (A-6) were members of an unlawful assembly with common object of causing death and were vicariously liable under Section 149 IPC; Darbesh Rai (A-2), who was found to have only stood at the door with a lathi and whose alleged instigation appeared exaggerated, was acquitted as there was reasonable doubt about his sharing the common object.
