Respondent Nos. 3 to 12, having already been absorbed in Group D posts as per available vacancies under an earlier scheme, could not be considered again for absorption or promotion in Group II/Grade C posts under a later scheme. Absorption of appellants in Group II/Grade C posts was valid, being by way of absorption (not promotion) in posts available at the relevant time. The process cannot be reopened each time a higher post becomes available, otherwise absorption schemes would never be final.
