ARM GROUP ENTERPRISES LTD. versus WALDORF RESTAURANT AND ORS.

A partnership firm or a sub-tenant (other than a tenant inferior to tenant of first degree) cannot claim status of protected tenant or resist execution of eviction decree under Section 13 of the West Bengal Premises Rent Control (Temporary Provisions) Act, 1950, unless necessary conditions precedent are established. The present firm in occupation through new partners cannot resist execution of the decree, as original tenant and sub-tenant have vacated premises and statutory protection does not extend to them.
