Where a contractor works beyond the formal extension of time without objection, contractual ceilings on escalation do not apply, and the arbitrator may properly award escalation for the extended period. The arbitrator’s findings on contributory delay and idling charges, having considered relevant factors, do not warrant interference. The arbitrator, under Section 3(1)(b) of the Interest Act, 1978, may award interest from the date of written notice, even for pre-reference periods, absent contractual prohibition.
