On the facts the Court found the accused formed an unlawful assembly armed with guns and spears and with a common object to cause at least grievous hurt such that culpable homicide was likely; the appellants were aggressors so the right of private defence did not justify the killing; principal accused who participated in the armed assault were liable under Section 304 Part I IPC and others who participated in abuse and scuffles were liable under Section 323/149 IPC; one accused who merely drove the tractor and committed no overt act was acquitted and released.
