In the absence of any provision in the Recruitment Rules as to how the fifth post of Reader should be filled, the executive decision of the State Government to permit promotion to the fifth post from amongst Lecturers of any discipline, based on merit and seniority, is valid provided it is not contrary to statutory rules. There is no prohibition in the Dental Council Regulations or Recruitment Rules against having two Readers in the same discipline; therefore, non-consideration of the respondent’s case solely on disciplinary grounds is a violation of Article 16.
