Ratio Decidendi

The 464 workmen specified in the list are workmen of the Food Corporation of India by virtue of the earlier Supreme Court judgment. The Tribunal's refusal to accept their identification was in error, since the only issue after remand was their identification, not their status, and the management had not seriously disputed their inclusion earlier. The correct procedure is for the Union to identify disputed persons, who must then be reinstated with backwages at 70% from 17.4.1990.
