The statutory protection granted under the Madras Cultivating Tenants Protection Act, 1955, is not confined to tenancies created by the original lessor or to tenants who existed at the commencement of the Act. The Act applies prospectively and protects all cultivating tenants as defined, including those inducted by life estate holders, irrespective of whether the tenancy originated before or after the Act came into force. The term 'landlord' in the Act encompasses successive holders entitled to evict, and statutory protection cannot be restricted by principles applicable to general estate law.
