Ratio Decidendi

The appeal is allowed: a subsequent purchaser is not entitled to claim lapsing of acquisition proceedings under the 2013 Act, and where possession of the land had been taken (here on 16.07.2007), acquisition proceedings cannot be deemed to have lapsed under Section 24(2) of the 2013 Act even if compensation was not tendered to the subsequent purchaser; the High Court's order declaring lapse on the sole ground of non-tendering is therefore quashed and set aside, following the Constitution Bench in Indore Development Authority v. Manoharlal.
