Although the trial court and High Court accepted evidence of dowry demand, the evidence was too sketchy to sustain conviction under Section 304-B IPC. However, the prosecution proved that the deceased was subjected to cruelty and mental harassment by her husband and mother-in-law, resulting in suicide within seven years of marriage. The basic ingredients of Section 306 IPC were established. Therefore, conviction under Section 304-B IPC was converted to Section 306 IPC, with sentence limited to period already undergone due to time spent in custody.
