Procedural Posture

Civil Appeal / On Appeal From High Court Judgment

  1. 1 Whether fixation of cut-off date 05.06.1995 for implementing the Pension Scheme was arbitrary and discriminatory under Article 14
  2. 2 Whether employees who retired prior to 05.06.1995 and received benefits under the Contributory Provident Fund Scheme constitute a different class from employees in service as on 05.06.1995

Ratio Decidendi

Employees who retired prior to 05.06.1995 had been governed by and had received benefits under the Contributory Provident Fund Scheme and thus form a different class from employees who were in service on 05.06.1995; the Corporation validly introduced the Pension Scheme effective from the date the Cabinet approved it (05.06.1995) and the fixation of that cut-off date was not arbitrary or discriminatory, so the High Court erred in quashing the cut-off date.
