The rejection of the application for voluntary retirement dated 21.01.2004 by communication dated 20.04.2004 was bad in law because the appointing authority failed to consider the employee's request for curtailment of the three months' notice on merits and gave no reasons; the proviso to Regulation 29(1) did not apply because the employee was transferred (not on deputation); accordingly the employee is entitled to retiral benefits under the Pension Regulations, 1995 and subsequent departmental enquiry proceedings are null and void.
