The Supreme Court held that the High Court erred by not considering the entire material and the fact that the complaint had an overwhelmingly civil character and had been compromised with the main accused whose proceedings had been closed; continuation of proceedings against the appellant thus amounted to an abuse of process and to secure the ends of justice the proceedings arising out of FIR No.179 dated 29.10.2009 and all consequential proceedings were quashed qua the appellant.
