Ratio Decidendi

In a case where genuineness of school leaving certificate has not been questioned, Sessions Court and High Court were not justified in placing reliance on statements made by mother or certificate issued by village Chowkidar. Law gives prime importance to date of birth certificate issued by school first attended. Accordingly, appellant was a juvenile on date of offence and should be tried by Juvenile Justice Board.
