Ratio Decidendi

Though the renewal requirements as to debtor may be satisfied when the same person is the debtor, the requirement regarding the creditor is not, unless the renewal is in favour of the same creditor or someone acting on his behalf or in his interest. Since the Bank had an independent existence and was not shown to act on behalf or in the interest of Narayana Iyer, the benefit of s. 8 is not available. Thus, the appellant is not entitled to have the debt scaled down.

Court Disposition

Appeal dismissed.
