Ratio Decidendi

Both the bus driver and the truck driver were negligent; the bus driver was speeding at night and the truck carried a protruding dumper unmarked with lights or reflectors in breach of Rule 331. The negligence of the truck driver contributed to the accident, but to a lesser degree than the bus driver. Apportionment should be 60% negligence for the bus driver and 40% for the truck driver. Liability for compensation is joint and several according to their respective contribution.
