Ratio Decidendi

Rectification proceedings against the 'Peter Scot' mark are barred on the principles of acquiescence and waiver, as respondents were aware of the mark's registration but did not act for several years. Limitation Act does not apply because Registrar is not a court. Tests for deceptively similar marks must be adapted to the specific goods, customers, and circumstances; and respondents failed to demonstrate deceptive similarity for the buyers of 'Scotch Whisky'. The Geographical Indications Act does not apply. Respondent No.1 has no locus standi under s.56 of the Trade and Merchandise Marks Act.
