Section 7 of the Punjab Trade Employees Act, 1940 is intra vires the Provincial Legislature as it falls within item 27 of List II ('trade and commerce within the Province') and item 27 of List III ('welfare of labour; conditions of labour') of the Government of India Act, 1935. The obligation to close a shop on a 'close day' attaches to the owner, irrespective of employment of outside labour or assistance from family members.
