Procedural Posture

Civil Appeal / Final Decision

  1. 1 Whether nomination by Hindu Ministers of the Leftist Democratic Front to Guruvayoor Devaswom Committee is illegal, unconstitutional and violates Articles 25 and 26 as requirement of being 'Hindu' not satisfied
  2. 2 Whether denomination of devotees has a right in administration after the 1978 Act
  3. 3 Interpretation of 'Hindu' under Guruvayoor Devaswom Act, 1978

Ratio Decidendi

The Guruvayoor Devaswom Act, 1978 does not require nominators to the Management Committee to be believers in temple worship; only members of the Committee need to be such believers. Debarring all Hindu Ministers of the leftist Government from nominating would lead to stalemate. Denomination of devotees has no right to administration under Articles 25 and 26 as no such rights existed prior to the Constitution. Only secular management is vested in Committee; spiritual matters remain with Thanthri.
