Ratio Decidendi

An arbitration agreement in an unregistered but compulsorily registrable document can be acted upon for dispute resolution, provided the document is duly stamped. If not duly stamped, neither the document nor any contained arbitration clause can be acted upon until the stamp duty and penalty are paid. Once duly stamped, the court may delink the arbitration agreement and enforce only the arbitration clause for disputes relating to the lease, but not enforce any substantive rights arising from the unregistered lease deed.
