Ratio Decidendi

Demolition of structures by municipal authorities without following due process is illegal; however, a structure found to be illegal cannot be allowed to be reconstructed simply because of procedural irregularity. In such cases, compensation may be granted, to be recovered from erring officials. If the structure is found to be legal, reconstruction should be permitted after proper verification and endorsement of existing by-laws. Proper statutory notice periods, as laid down in Sopan Maruti Thopte and under s.351 of MMC Act, must always be observed. Substantial directions for technological mapping and evidence collection are issued for future compliance.
