Ratio Decidendi

Construction of building beyond 5 1/2 floors was illegal and unauthorized without any properly sanctioned plans. Only the plans approved for up to 5 1/2 floors by the competent authority are valid. Addition of extra floors falls under non-compoundable items; as such, 6th, 7th, and 8th floors must be demolished, and half of the 5th floor, unless compounded based on representations. Public notice suffices as individual notice under Section 88. Flat owners whose flats are to be demolished may seek remedies according to law.
