In compulsory acquisition under the Land Acquisition Act, 1894, completion of transfer for purposes of Section 45 (Income-tax Act, 1961) correlates with statutory vesting by taking possession: where ordinary procedure under Section 16 applies, capital gains accrue on making of the award; where urgency under Section 17 applies, capital gains accrue after expiry of fifteen days from publication of the Section 9(1) notice; on the facts the acquisition followed the ordinary process and vesting (and thus accrual of capital gains) occurred on the date of award 29.09.1970, not on the notification date 15.05.1968.
