Seniority and promotion must be determined as per the service rules, which require confirmation only after satisfactory completion of probation and passing departmental examination. The principle of merit-cum-seniority applies, where merit (as evidenced by departmental examination) outweighs seniority by date of joining; therefore, those who are confirmed earlier on merit cannot be made junior to those who joined earlier but were confirmed later. The High Court order granting promotion based solely on date of joining, without regard to confirmation and departmental examination, contravenes the rules and is unsustainable.
