Procedural Posture
Civil Appeal / Appeal Against Division Bench Judgment and Order Dated 11.12.2002 of Calcutta High Court (w.p.s.t. No. 1044/2002)
Legal Issues
- 1 Whether private respondents could be made seniors to the appellants solely on the ground that they joined the service earlier to the appellants' date of joining?
- 2 Applicability of merit-cum-seniority principle in determining inter se seniority for promotion as per relevant West Bengal Service Rules
Ratio Decidendi
Seniority and promotion must be determined as per the service rules, which require confirmation only after satisfactory completion of probation and passing departmental examination. The principle of merit-cum-seniority applies, where merit (as evidenced by departmental examination) outweighs seniority by date of joining; therefore, those who are confirmed earlier on merit cannot be made junior to those who joined earlier but were confirmed later. The High Court order granting promotion based solely on date of joining, without regard to confirmation and departmental examination, contravenes the rules and is unsustainable.
Court Disposition
Appeal allowed; High Court judgment and order dated 11.12.2002 set aside.
Orders
- Notification dated 28.3.2001 restored.
- Promotion and seniority to be determined in accordance with relevant service rules; confirmation and passing departmental examination are prerequisites.
