  1. 1 Whether by virtue of the nomination, the appellant obtained a status or a right in law or became the holder of an office
  2. 2 Whether the defendant was competent to cancel the nomination without good cause

Ratio Decidendi

The Supreme Court held that a valid nomination to the office of junior head (Elavarasu) in the Kasi Mutt creates a legal status carrying the incident of capacity to succeed to the headship, and such status cannot be revoked or cancelled by the nominated person's appointer at will. The nomination can only be withdrawn or revoked for good cause. The revocation of the appellant's nomination was not supported by good cause and was thus bad in law. The appellant was entitled to the status of Elavarasu during the defendant's lifetime and to succeed as the head of the Mutt upon the latter's death.
