The Indian Forest Act (Bihar Amendment) Act, 1990 and the Bihar Forest Produce (Regulation of Trade) Act, 1984 serve distinct purposes and can coexist. The provisions of Section 32 of the Trade Act are exclusionary only in respect to matters for which provisions are made in the Trade Act. The powers conferred on authorities under the amended Indian Forest Act for confiscation are not excluded and can be exercised notwithstanding the Trade Act; the High Court erred in holding otherwise. Special procedure under the Bihar Amendment Act empowers authorities with comprehensive and stringent powers for confiscation to the exclusion of the Courts, and this cannot be curtailed by the Trade Act.
