Legal Issues
- 1 Whether non-compliance with Rule 22 of Prevention of Food Adulteration Rules, 1955, vitiates trial or conviction under section 16(1)(a)(i) of the Prevention of Food Adulteration Act, 1954
- 2 Whether Rule 22 is mandatory or directory
- 3 Whether acquittal orders based on previous Supreme Court decisions should be disturbed
Ratio Decidendi
Non-compliance with Rule 22 of Prevention of Food Adulteration Rules, 1955 does not necessarily vitiate the trial or conviction under section 16(1)(a)(i) of the Prevention of Food Adulteration Act, 1954. Rule 22 is directory and substantial compliance is sufficient if the quantity sent to the Public Analyst enables correct analysis. Mere technical non-compliance should not result in acquittal where public health interests are otherwise served. The earlier decision in Pamanani's case was overruled.
Court Disposition
Appeals allowed; correct law laid down; no consequential orders; acquittals undisturbed.
Orders
- Correct proposition of law established: Rule 22 is directory, not mandatory.
- No consequential orders setting aside acquittals or remitting cases.
