Ratio Decidendi

The High Court was not justified in reducing the sentence to the period already undergone without awarding any compensation to the heirs of the deceased. In cases where accused cannot pay adequate compensation, the State is required to pay compensation under Section 357-A of the CrPC. Accordingly, the order of the High Court is modified: the accused must pay Rs. 2 lakhs to the heirs within 6 months, or serve RI for 6 months in default; the State must pay interim compensation of Rs. 3 lakhs and, if the accused defaults, must pay an additional Rs. 2 lakhs, totaling Rs. 5 lakhs.
